Mobile Service Agreement

Adrian's Auto Care LLC

This Service Agreement ("Agreement") is entered into between Adrian's Auto Care LLC ("Provider") and the customer requesting service ("Customer"), effective as of the date service is scheduled or performed.

1. Scope of Work

Provider agrees to perform the mobile automotive repair/diagnostic services requested by Customer ("services") at the location specified by Customer. Any additional repairs discovered during service will be communicated to Customer and require separate authorization before work proceeds.

2. Estimates

All prices quoted are estimates only and may vary based on vehicle make/model, condition, and additional labor required. Any final increases in pricing will be confirmed with Customer prior to completion of work.

3. Payment Terms

Payment in full is due immediately upon completion of services, before Provider departs the service location. A mobile technician fee of 10–15% and applicable sales tax apply to every transaction. Any invoice not paid at time of service will accrue a late fee until paid in full. If Customer refuses or fails to pay for completed services, Provider reserves the right to place a mechanic's lien on the vehicle to the extent permitted by state law, pursue collections and/or small claims action for the amount owed plus reasonable collection costs and attorney's fees, and report the debt to applicable collection agencies. By authorizing services, Customer agrees to full payment for all services performed in accordance with the agreed-upon scope of work and completed in a professional and workmanlike manner.

4. Parts

Parts supplied by Provider carry a 12-month/12,000-mile warranty on the part itself and correct installation, unless otherwise stated. Customer-supplied parts are installed at Customer's request and risk; Provider offers no warranty on customer-supplied parts.

5. Parts Deposit & Pre-Payment Policy

5.1 Deposit Threshold & Requirement

For any service where the total cost of parts and materials exceeds $500, an upfront deposit equal to 50% of the total parts cost is required before any parts orders are placed.

5.2 Application of Deposit

The deposit will be applied directly to your final invoice. The remaining balance, consisting of the remaining parts balance, labor, travel fees, and any applicable shop fees, is due immediately upon completion of the service.

5.3 Credit Card Processing Fee

All electronic credit and debit card payments made toward parts deposits or final balances are subject to a 3% processing fee to cover merchant transaction costs. Clients may waive this fee completely by paying via Zelle, Cash App, Venmo, direct bank transfer (ACH), or cash.

5.4 Cancellation and Refundability

  • Special Order/Non-Returnable Parts: Deposits for specialty, custom, or dealer-only OEM parts are completely non-refundable once the order is placed.
  • Standard Returnable Parts: If you cancel your appointment at least 24 hours prior to the scheduled service time, your deposit will be refunded, minus any restocking fees, return shipping costs charged by our parts suppliers, and non-refundable merchant processing fees.
  • Late Cancellations: Cancellations made less than 24 hours before the appointment may result in the forfeiture of the parts deposit or a restocking penalty, at the sole discretion of Adrian's Auto Care LLC.

5.5 Payment Methods

Deposits must be paid securely online via credit card, debit card, or digital payment link provided on your electronic estimate. Parts will not be sourced until payment is verified.

6. Limitation of Liability

6.1 Financial Cap

To the maximum extent permitted by law, Provider's total liability for any claim arising from the services is limited to the amount paid by Customer for the specific service giving rise to the claim.

6.2 Excluded Damages

Provider is not liable for indirect, incidental, consequential, or special damages arising from the services, including but not limited to towing fees, rental car costs, or loss of income.

6.3 Property & Environment

Provider is not responsible for damage to the service location property, including oil/fluid stains on driveways or parking lot surfaces.

6.4 Condition of Vehicle

Provider is not responsible for pre-existing conditions, undisclosed defects, issues unrelated to the services performed, or the failure of aged, brittle components adjacent to the repair area during standard disassembly.

7. Warranty Disclaimer

Except as expressly stated in Section 5, Provider makes no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

8. Right to Refuse/Stop Service

Provider reserves the right to refuse or stop services if the work environment is unsafe, if additional undisclosed damage is discovered, or if Customer fails to cooperate or pay for prior work.

9. Dispute Resolution

Any dispute arising from this Agreement shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved via binding arbitration or small claims court, at Provider's election, and the prevailing party shall be entitled to recover reasonable attorney's fees and costs.

10. Acceptance

By checking the acceptance box and signing on the booking form, Customer acknowledges having read and agreed to this Agreement as of the date of the service request.
